Sayani Gupta’s directorial debut Aasmani The Dispute Settlement Committee (DSC) of the Screenwriters Association (SWA) cleared him of copyright infringement charges. After reviewing both sides’ submissions and conducting independent peer comparisons, the DSC noted that the two papers shared only the basic idea. In the committee’s opinion, the narrative, character development, conflict and overall storyline were different in the two works.
The DSC also noted that copyright law protects the expression of an idea, not the idea itself. It also took into account that the applicant’s work was a documentary film based on the well-known life of a real person.
The committee also referred to a separate defamation suit filed by Gupta against the complainant. The court has reportedly ruled in favor of Gupta in this matter. Because some of the issues raised in the defamation proceedings are consistent with the issues raised in DSC’s complaint, the matter is currently pending judicial review, preventing DSC from proceeding with the matter further.
Accordingly, the SWA proceeding was concluded and the complaint was closed, without prejudice to the legal rights and remedies available to either party.
Development occurs as Aasmani continues its international festival journey. A copyright infringement complaint arose during the film’s festival screening, and the closure of the proceedings ended the dispute at SWA.
Reacting to the development, Gupta said, “As I said earlier, the truth will always prevail. I respected the process and was grateful that the truth came out. It always does. It was the most harrowing experience of my life. But as my grandmother often quoted Tagore and said, ‘tomar potaka jaare dao, bohibare dao shokoti..’ “Whoever you give your flag, you also give him the power to carry it. him.”
